The purpose of these pages is to provide you with an overview of the types of things MyFamily.com (“we”, “our” or “us”) expects from you, as a member of the Service, and the types of things you may expect from us, as the provider of the Service. Your Agreements
  1. The Service is generally intended for use by adults. If you invite a minor child to join your Family Web Site, you are responsible for monitoring your child’s activity on that site.
  2. If you are an adult Member of the Service, you are responsible for any and all usage or activity that originates within or occurs using your account or password, including by the minor children that you expressly invite to your Family Web Site.
  3. You are responsible for keeping your password secure.
  4. You may not use the Service for any commercial purpose whatsoever.
  5. You may not use the Service for any illegal or unauthorized purpose, or any other purpose which is expressly prohibited by the site Terms and Conditions.
  6. You will not upload any content to the Service that violates any copyright or other intellectual property rights of others.
  7. You will not abuse, harass, threaten, or seek to offend other Members or other users in any way.
  8. You are solely responsible for your conduct and for any Content that you Post or use on the Service.
  9. When you Post Content to the Service, you grant us a limited license to host that Content as part of the Family Web Site to which it was submitted, to use it in connection with derivative works that you or other Members of that Family Web Site create using the Service (such as slideshows or photo prints), and to distribute it to individuals or to other Family Web Sites in accordance with the privacy setting which apply to the Family Web Site to which you submitted the Content.
  10. You must not use the Service to create or submit unwanted email (otherwise known as “spam”) to any other Members or users of the Service or otherwise.
  11. You must not use the Service to transmit any worms or viruses or any code of a destructive nature.
  12. You must not modify, adapt or hack the Service or modify another Web site so as to falsely imply that it is associated with the Service.
  13. Recognizing the global nature of the Internet, you agree to comply with all applicable local laws, including but not limited to those regarding online conduct, privacy, copyright and content.
General Conditions to Use of the Service and Our Agreements
  1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
  2. We reserve the right to refuse to provide the Service to anyone for any reason at any time. Among other things, if you violate our site Terms and Conditions, we may terminate your access to the Service and refuse to continue to make the Service available to you.
  3. We reserve the right to change our site Terms and Conditions at any time. If any change made to our site Terms and Conditions constitutes a material change, we will notify you of the change via e-mail. We are entitled to determine, in our sole discretion (but in good faith), whether any change constitutes a "material” change for these purposes.
  4. We may, but have no obligation to, review, and/or remove, user-contributed Content from any Family Web Site (whether Public or Private) or from the Service that we determine, in our sole discretion, is unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or which violates any party's intellectual property rights, our site Terms and Conditions or applicable law.
  5. If you elect to purchase a paid membership to the Service, your membership fees will be automatically charged to the credit card that you provide on a recurring basis at each renewal date, based on the membership type you choose (e.g., annual, monthly, etc.).
  6. Except in the case of any monthly subscription (in which case, no such notices will be given), you will be notified by e-mail 15 days before your subscription automatically renews, and asked to correct any of your membership or other information that has changed. This notification will also be an opportunity to "opt out" of your renewal. Cancellation requests must be received at least two days before the renewal date for the cancellation to be effective.
  7. If you do not agree with the Terms and Conditions which apply to our to our Service, or to any changes which we may make to our site Terms and Conditions, your sole remedy is to not use or to discontinue using the Service, and we disclaim any other liability to you.

  • You may refuse to provide personal information to us, and still use portions of the Service.
  • In order to become a Member of the Service (which, among other things, will allow you to view those Private Family Web Sites to which you have been invited, and to post Content to and to comment on Content which has been posted by others on such sites), you will need to provide us with some limited personal information, including a name and address. You will also need to select a username and password, and provide us with provide us with a valid and verifiable e-mail address.
  • If you want to subscribe to any of the paid portions of the Service, which will enable you to, among other things, create your own Family Web Site(s), then you must provide us with certain other personal and some financial information.
  • We respect your privacy and are committed to protecting your personal information. To the extent you do provide us with personal information, we will use your personal or information only for the following purposes:
    • to facilitate communications to other Members of your Family Web Site;
    • to process and fulfill orders that you place through your Family Web Site, the MyFamily.com Web site or any online store or shop operated by any of our affiliates; or
    • to keep you informed of new product developments by us or our affiliates, and invite you to share your opinions about the MyFamily.com Web site or the Service.
  • We will not share your personal information with third parties. When we deal with potential advertisers, partners, sponsors or like entities, to the extent we provide any Member or subscriber information, we provide only aggregated statistics. For example, we may say something like “10,000 of our members have indicated an interest in golf”.
  • We do reserve the right, however, to disclose your personal information as may be required by law or judicial process, or if we reasonably believe disclosure is necessary to protect our rights.
  • We automatically collect information from IP addresses, cookies and Web logs each time a user visits the Web site. We use the information to provide you with a personalized Web experience. You can always modify your browser preferences to accept all cookies, be notified when a cookie is set or reject all cookies.
  • You may, at any time, “opt out” of marketing communications from us or our affiliates, and we will give you instructions on how to do so in each such communication.
